Terms on which we make this site available.

These terms apply to everyone who uses versatilegroupbb.com, wherever you are. Please read them — by using the site you accept them. They do not govern any construction contract between us.

1Acceptance

This website is operated by Versatile Group of Companies of St. Patrick's, Christ Church, Barbados BB17074 (“Versatile Group”, “we”, “us”). By accessing or using it you agree to these Terms of Use. If you do not agree, please do not use the site.

We may change these terms at any time by posting a revised version here. The effective date at the top shows when they last changed, and continued use after that date is acceptance of the revision.

2Permitted use

You may view, download and print material from this site for your own information and for the purpose of evaluating or engaging our services. You may not:

copy, republish, sell, licence or commercially exploit any part of the site without our written permission;
use the site for anything unlawful, fraudulent or harmful, or in breach of any applicable sanctions or export controls;
submit false, misleading or impersonating information through our forms, or submit anyone else’s personal information without their authority;
use automated means to scrape, harvest or systematically extract content or contact details;
transmit malware, attempt to gain unauthorised access to any part of the site or its underlying systems, or interfere with its operation;
probe, scan or test the vulnerability of the site or circumvent any security or rate-limiting measure.

We may suspend or block access, without notice, where we reasonably believe this clause has been breached.

3Intellectual property

All content on this site — text, photography, drawings, graphics, layout, design, logos and the compilation of it — is owned by or licensed to the Versatile Group and protected by copyright, trade mark and other laws. “Versatile Group of Companies”, “Versatile Construction Inc”, “Versatile Homes”, “The Furniture Boutique” and “Casa Bella Lux”, together with their logos, are our marks.

Third-party names, marks and photographs appearing on this site — including those of clients, hotel groups, brands and developments we have worked with — remain the property of their respective owners and are shown to identify completed work. Their appearance does not imply any endorsement, partnership or ongoing relationship beyond the work described.

If you believe content here infringes your rights, write to info@versatilegroupbb.com with details and we will investigate promptly.

4Project and service information

Project descriptions, sectors, locations, scopes, photographs, timelines and any figures on this site are provided for general information only. They are illustrative of the type and scale of work the group undertakes.

They are not, and must not be relied on as, a representation, warranty, offer, quotation or estimate, and they do not form part of any contract. Photographs may show work at various stages, may have been edited for presentation, and may depict projects delivered by different companies within the group. Scope and responsibilities on any given project are defined solely by the signed contract for that project.

Nothing on this site constitutes construction, engineering, architectural, surveying, financial, investment, tax or legal advice. Any decision to proceed should be based on our written proposal and your own professional advice.

5Enquiries and submissions

Submitting an enquiry does not create a contract, a professional relationship or any obligation on us to provide services, quote, tender or respond. We may decline any enquiry at our discretion and are not obliged to give reasons.

Any response times we mention — such as replying within one business day — are service targets, not contractual commitments.

Do not send confidential, privileged or commercially sensitive material through this website unless we have asked you to. Information sent through the forms is not treated as confidential unless a confidentiality agreement is in place, though we handle everything in line with our Privacy Policy.

If you send us an idea, suggestion or concept unsolicited, you grant us a non-exclusive, royalty-free, worldwide licence to use it without obligation or compensation. We receive many enquiries and may independently develop similar ideas.

You confirm that information you submit is accurate, that you are entitled to provide it, and that where it relates to another person you have their authority.

6Availability of the site

We aim to keep the site available but do not guarantee uninterrupted or error-free access. We may suspend, withdraw or restrict all or part of it for maintenance, upgrade or business reasons without notice or liability.

You are responsible for your own arrangements to access the site, and for ensuring that anyone accessing it through your connection is aware of these terms.

7Third-party links and content

This site links to third-party websites and embeds third-party content, including maps and analytics. We do not control those sites or services, do not endorse them, and accept no responsibility for their content, availability, security or privacy practices. Following an external link is at your own risk and subject to that site’s own terms.

8Disclaimers

The site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we exclude all representations, warranties, conditions and terms, whether express or implied by statute, common law or otherwise, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, non-infringement, and any warranty that the site will be secure, error-free, uninterrupted or free of viruses or other harmful components.

We do not warrant that information on the site is accurate, complete or current. Content may be out of date, and we are under no obligation to update it.

9Limitation of liability

To the fullest extent permitted by law, the Versatile Group, its companies, directors, officers, employees, agents and suppliers shall not be liable for any:

indirect, incidental, special, consequential, punitive or exemplary loss;
loss of profit, revenue, business, contracts, anticipated savings, goodwill or opportunity;
loss or corruption of data;
loss arising from your use of, or inability to use, the site, or from reliance on any content on it;
loss arising from any virus, denial-of-service attack or other harmful material that may infect your equipment through your use of the site;
loss arising from any third-party website or service linked to or embedded in the site,

whether the claim arises in contract, tort (including negligence), breach of statutory duty or otherwise, and whether or not the loss was foreseeable or we were advised of its possibility.

Where liability cannot lawfully be excluded, our total aggregate liability to you arising out of or in connection with this website and these terms is limited to one hundred Barbados dollars (BBD $100).

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, these terms do not affect your statutory rights.

10Your indemnity to us

You agree to indemnify and hold harmless the Versatile Group, its companies, directors, officers, employees and agents against any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or in connection with:

your breach of these terms;
your misuse of the site;
any information you submit that is false, infringing, unlawful or provided without the authority of the person it concerns.

11These terms do not govern our projects

These terms govern your use of this website only. Any construction, development, millwork, supply or other service provided by a company within the Versatile Group is governed exclusively by the separate written contract for that engagement.

Where anything on this website conflicts with such a contract, the contract prevails. Nothing on this site varies, waives or adds to the terms of any contract between us.

12Privacy

Our handling of personal information is described in our Privacy Policy, our Cookie Policy and our Barbados Data Protection Act notice, which form part of these terms.

13Governing law and disputes

These terms, their subject matter and their formation are governed by the laws of Barbados. The courts of Barbados have exclusive jurisdiction over any dispute arising out of or in connection with them, and you submit to that jurisdiction.

If you are a consumer resident in a country whose law gives you the right to bring proceedings in your own courts, or the protection of mandatory local consumer law, this clause does not deprive you of that right or protection.

Before commencing proceedings, we ask that you contact us at info@versatilegroupbb.com so we can try to resolve the matter directly. Most issues are settled quickly this way.

14General

Severability

If any provision is found unlawful, invalid or unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in force.

No waiver

A failure or delay in enforcing any provision is not a waiver of it, and does not prevent later enforcement.

Entire agreement

These terms, together with the policies referred to in them, are the entire agreement between us regarding this website and supersede any prior understanding. You confirm you have not relied on any statement not set out in them, save that nothing limits liability for fraudulent misrepresentation.

Third parties

Other than companies within the Versatile Group and the people named in clauses 9 and 10, no third party has any right to enforce these terms.

Assignment

We may assign or transfer our rights and obligations under these terms. You may not without our written consent.
